Nijan ("we," "us," "our") is an Indian print-on-demand lifestyle brand operating through our online store at nijan.in. We design and sell custom-printed apparel, accessories, and lifestyle products that are made to order and shipped directly to customers across India.

2. Acceptance of Terms

By accessing or placing an order on nijan.in, you confirm that you have read, understood, and agree to be bound by these Terms of Service and all policies linked within, including our Shipping Policy, Return & Refund Policy, and Privacy Policy. If you do not agree to these terms, please do not use this website or place an order.

These terms are governed by the laws of India and comply with:

  • Consumer Protection Act, 2019
  • Consumer Protection (E-Commerce) Rules, 2020
  • Information Technology Act, 2000
  • Digital Personal Data Protection Act, 2023
  • Goods and Services Tax Act, 2017

3. Products and Orders

Made to order: Every Nijan product is printed specifically when an order is placed. We do not hold pre-manufactured stock.

Product descriptions: We make every effort to display product colours, designs, and descriptions as accurately as possible. However:

  • Screen colours may vary slightly from printed colours — this is inherent to the print-on-demand process and is not considered a defect
  • A size measurement tolerance of ±0.5 inches is standard in apparel manufacturing
  • Actual fabric texture may vary slightly from product photographs

Order confirmation: Placing an order constitutes an offer to purchase. We reserve the right to accept or reject any order. Order confirmation via email or WhatsApp constitutes acceptance of your order.

COD orders: For Cash on Delivery orders, we will confirm your order via WhatsApp before sending it for production. Failure to respond to confirmation within 48 hours may result in your order being cancelled.

Order cancellation: Once an order is confirmed and sent for production, it cannot be cancelled. If you wish to cancel before production begins, contact us immediately at hello@nijan.in or WhatsApp.

4. Pricing and Payment

  • All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes
  • GST at the applicable rate is included in the displayed price
  • We accept payment via UPI, credit/debit cards, net banking, and Cash on Delivery
  • COD orders attract an additional handling fee as displayed at checkout
  • Prices are subject to change without notice — the price at the time of order confirmation is the final price

5. Intellectual Property

All content on nijan.in — including brand name, logo, design lines, collection names, taglines, photography, and written content — is the intellectual property of Nijan and is protected under applicable Indian intellectual property laws.

  • You may not reproduce, copy, distribute, or use any Nijan content without prior written permission
  • Our brand name "Nijan" and tagline "Made for the uncurated" are proprietary brand assets
  • Product designs created by Nijan are original works and may not be replicated or resold

6. Grievance Redressal — Mandatory Under Consumer Protection (E-Commerce) Rules 2020

As required under the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer for consumer complaint redressal:

7. Limitation of Liability

To the maximum extent permitted by Indian law:

  • Nijan's liability for any claim arising from a product purchase is limited to the amount paid for that specific order
  • We are not liable for delays caused by courier partners, natural events, or circumstances beyond our control
  • We are not liable for indirect, incidental, or consequential damages arising from use of our products or website
  • Colour variations between screen display and printed product are inherent to the print-on-demand process and do not constitute grounds for liability

8. Privacy and Data Protection

We collect and process personal data (name, address, phone number, email) solely for the purpose of fulfilling your order and communicating with you about it. We comply with the Digital Personal Data Protection Act, 2023.

  • We do not sell, share, or rent your personal data to third parties for marketing purposes
  • Your data is shared only with our payment partner and production partner to the extent necessary to fulfill your order
  • You have the right to request access to, correction of, or deletion of your personal data by contacting hello@nijan.in

9. Cookies

By using nijan.in you agree not to:

  • Use the website for any unlawful purpose
  • Submit false or misleading information
  • Attempt to gain unauthorised access to any part of the website

11. Governing Law and Dispute Resolution

These terms are governed by the laws of India. Any disputes arising from purchases on nijan.in shall be subject to:

  • First, an attempt at resolution through direct communication with our Grievance Officer (details in Section 6)
  • If unresolved within 30 days, disputes may be referred to the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019
  • The jurisdiction for any legal proceedings shall be the courts of Ernakulam, Kerala, India

12. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of nijan.in after changes are posted constitutes acceptance of the revised terms.
