Nijan ("we," "us," "our") is committed to protecting your personal data in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 ("DPDP Act"). By using nijan.in or placing an order with us, you agree to this Privacy Policy.

Under the DPDP Act, Nijan acts as a Data Fiduciary — meaning we determine the purpose and means of processing your personal data.

Personal data we collect

We collect only what's necessary to fulfil your order and run our store:

  • Contact details — name, email address, phone number, billing and shipping address
  • Order and transaction data — order history, items purchased, payment transaction references, refund details
  • Account data — username and encrypted password, if you create an account
  • Communications — messages you send us via email, WhatsApp, or our contact form
  • Technical data — IP address, browser type, device information, cookies, and usage analytics

We do not knowingly collect personal data from children under 18 years of age.

How we use your data

We process personal data only for:

  • Fulfilling your order — production, shipping, delivery, and returns/refunds

Your rights

As a Data Principal under the DPDP Act, you have the right to:

  • Access — request a summary of the personal data we hold about you and how it's processed
  • Correction — request that we fix inaccurate or incomplete data
  • Erasure — request that we delete your personal data, subject to legal retention requirements
  • Grievance redressal — raise a complaint about how we collect, use, or process your data
  • Nominate — name another individual to exercise these rights on your behalf in the event of your death or incapacity

We may need to verify your identity before processing it. We'll acknowledge your request within 3–5 working days and aim to resolve it within 15 working days, though certain data may be retained where required by law.

Children's data

Nijan does not knowingly process personal data of anyone under 18 years of age. We do not track, profile, or serve targeted advertising to children under any circumstances. If we discover we've inadvertently collected a child's data, we'll delete it promptly — contact us if you believe this applies to you or your child.

Data security

We use reasonable technical and organisational safeguards to protect your data, including SSL encryption, secure payment gateway integration, and access controls on our systems. No online service can guarantee perfect security, so please avoid sharing sensitive information with us through unsecured channels. In the event of a data breach, we will notify the Data Protection Board of India and affected users as required under the DPDP Act.

Data retention

We retain personal data only as long as necessary to fulfil your order, meet tax and accounting obligations, and resolve any disputes. Once it's no longer needed, we delete or anonymise it.

Who we share your data with

We share limited personal data with trusted third parties where necessary to run our business:

  • Shopify, which hosts our store and processes data on our behalf
  • Payment gateway providers, to process your payment
  • Qikink and our courier partners, to produce and deliver your order
  • Auditors, legal advisors, and regulators, where required by law
  • Meta (Facebook and Instagram), to run and measure our advertising using tools like the Meta Pixel and Conversions API

Every third party we share data with is contractually required to keep it confidential, secure it appropriately, and use it only for the purpose we've shared it for.

Cross-border data transfers

Because our store runs on Shopify's infrastructure, your data may be processed on servers located outside India. Any such transfer complies with restrictions notified by the Government of India under the DPDP Act.

Cookies

We use cookies to enable core store functionality (like your cart) and to understand how visitors use our site. You can disable cookies in your browser settings, though this may affect how well the site works.
